Bir \u00f6nceki yaz\u0131m\u0131zda tahliye hususunda ili\u015fkin Bor\u00e7lar Kanunundaki d\u00fczenlemelerden k\u0131saca bahsetmi\u015ftik. Bu yaz\u0131m\u0131zda ise ilgili kanun maddelerinde ne demek istedi\u011fi, izlenmesi gereken yollar vb. a\u00e7\u0131klamal\u0131 \u015fekilde bahsedilecektir.<\/p>\n\n\n\n
Kiraya veren taraf\u0131ndan kirac\u0131n\u0131n tahliye edilmesinin m\u00fcmk\u00fcn oldu\u011fu durumlar a\u015fa\u011f\u0131daki gibi s\u0131ralanabilir.<\/p>\n\n\n\n
TBK m. 354<\/strong> h\u00fckm\u00fc uyar\u0131nca dava sebeplerinin kirac\u0131 aleyhine de\u011fi\u015ftirilmesi yasakt\u0131r. Dolay\u0131s\u0131yla tahliye davas\u0131nda tahliye sebepleri ancak kanunda belirtilenler ile s\u0131n\u0131rl\u0131d\u0131r.<\/p>\n\n\n\n Kiraya Verenin veya Yak\u0131nlar\u0131n\u0131n Konut Gereksinimi Nedeniyle Feshetme Hakk\u0131<\/u><\/strong><\/p>\n\n\n\n TBK m. 350 h\u00fckm\u00fcnde say\u0131lan ve kiraya verenin, kendisi, e\u015fi, altsoyu ve \u00fcstsoyunun, kiraya verenin yak\u0131nlar\u0131n\u0131n kiralanan ta\u015f\u0131nmaza ihtiya\u00e7 duymas\u0131 halinde kiraya verenin, tahliye davas\u0131 a\u00e7arak kira s\u00f6zle\u015fmesini sona erdirme hakk\u0131na sahip oldu\u011fundan bir \u00f6nceki yaz\u0131m\u0131zda bahsetmi\u015ftik. Bu t\u00fcr tahliye davas\u0131nda konut gereksiniminin ger\u00e7ek ve samimi olmas\u0131 gerekmektedir. Konut ihtiyac\u0131, kiraya verenin bulundu\u011fu duruma, ya\u015fam \u015fartlar\u0131na g\u00f6re de\u011ferlendirilir. \u00d6rne\u011fin sa\u011fl\u0131k durumu asans\u00f6rs\u00fcz bir apartmanda oturmaya elveri\u015f g\u00f6stermeyen ev sahibi, konut ihtiyac\u0131 sebebiyle asans\u00f6rl\u00fc ya da alt katlarda bulunan dairesine ta\u015f\u0131nmak i\u00e7in i\u015f bu davay\u0131 a\u00e7abilecektir.<\/p>\n\n\n\n Ancak bilinmelidir ki, \u0130htiya\u00e7 Nedeniyle tahliye davas\u0131 a\u00e7arak kirac\u0131s\u0131n\u0131 tahliye eden ev sahibinin, 3 y\u0131l ge\u00e7medik\u00e7e, gereksinim amac\u0131yla tahliye edilen kiralanan\u0131, kirac\u0131dan ba\u015fkas\u0131na kiralamas\u0131 kanunla yasaklanm\u0131\u015ft\u0131r. (TBK m. 355).<\/strong>Kiraya veren yeniden kiralama yasa\u011f\u0131na ayk\u0131r\u0131 davrand\u0131\u011f\u0131 takdirde, haks\u0131z tahliye nedeniyle kirac\u0131n\u0131n tazminat talebi ileri s\u00fcrme hakk\u0131 bulunmaktad\u0131r. Kirac\u0131ya \u00f6denecek tazminat, son kira y\u0131l\u0131nda \u00f6denen 1 y\u0131ll\u0131k kira bedelinden az olamaz.<\/p>\n\n\n\n Tahliye davas\u0131n\u0131n belirli s\u00fcreli kira s\u00f6zle\u015fmesinin sona ermesinden ve belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine veya fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak 1 ay i\u00e7inde a\u00e7\u0131lm\u0131\u015f olmas\u0131 gerekir<\/p>\n\n\n\n Kiraya Verenin \u0130\u015fyeri Gereksinimi Nedeniyle Fesih Hakk\u0131<\/u><\/strong><\/p>\n\n\n\n Yine kiraya veren; kendisinin, e\u015finin, altsoyunun, \u00fcstsoyunun ya da kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filerin i\u015fyeri gereksinimi nedeniyle kiralad\u0131\u011f\u0131 i\u015fyerini kirac\u0131n\u0131n bo\u015faltmas\u0131 i\u00e7in tahliye davas\u0131 a\u00e7abilir. <\/strong>Bu t\u00fcr tahliye davas\u0131nda da i\u015fyeri gereksiniminin ger\u00e7ek ve samimi olmas\u0131 gerekmektedir. Yarg\u0131lama sona ermeden i\u015fyeri gereksinmesi ortadan kalkarsa tahliye davas\u0131 reddedilir.\u00a0<\/p>\n\n\n\n Tahliye davas\u0131n\u0131n belirli s\u00fcreli kira s\u00f6zle\u015fmesinin sona ermesinden ve belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine veya fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak 1 ay i\u00e7inde a\u00e7\u0131lm\u0131\u015f olmas\u0131 gerekir.<\/p>\n\n\n\n Yeni Malikin Gereksinimi Nedeniyle Tahliye Hakk\u0131<\/u><\/strong><\/p>\n\n\n\n Kira s\u00f6zle\u015fmesi kurulduktan sonra kiralanan ta\u015f\u0131nmaz herhangi bir sebeple el de\u011fi\u015ftirirse, yeni malik kira s\u00f6zle\u015fmesinin taraf\u0131 olur. \u0130htiyac\u0131 olmas\u0131 halinde ise yeni sahip, kirac\u0131ya kar\u015f\u0131 tahliye davas\u0131 a\u00e7arak kira s\u00f6zle\u015fmesini sona erdirme hakk\u0131na sahiptir. Ancak kira s\u00f6zle\u015fmesinin tapuya \u015ferh edilmesi halinde yeni malik bu haktan yararlanamaz. Bu t\u00fcr tahliye davas\u0131nda da i\u015fyeri gereksiniminin ger\u00e7ek ve samimi olmas\u0131 gerekmektedir.<\/p>\n\n\n\n Yeni malikin, kendisinin, e\u015finin, altsoyunun, \u00fcstsoyunun veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filerin konut ya da i\u015fyeri gereksiniminin ispatlanm\u0131\u015f olmas\u0131 gerekir.<\/p>\n\n\n\n Ayr\u0131ca yeni malikin ta\u015f\u0131nmaz\u0131 edinim tarihinden itibaren 1 ay i\u00e7inde kirac\u0131ya yaz\u0131l\u0131 bildirim ile konut ya da i\u015fyeri gereksinimi dolay\u0131s\u0131yla kiralanan\u0131 tahliye etmesini talep etti\u011fini bildirmesi gerekir. <\/strong>Bir sonraki a\u015fama ise, yeni malikin ta\u015f\u0131nmaz\u0131 edinim tarihinden itibaren 6 ay ge\u00e7tikten sonra tahliye davas\u0131 a\u00e7m\u0131\u015f olmas\u0131d\u0131r.<\/p>\n\n\n\n Kiraya Verenin Tadilat Nedeniyle Tahliye Hakk\u0131<\/u><\/strong><\/p>\n\n\n\n Kiralananda esasl\u0131 tadilat yap\u0131lmas\u0131n\u0131n gerekmesi ve bu esnada kiralanan\u0131n kullan\u0131m\u0131n\u0131n imk\u00e2ns\u0131z olmas\u0131 da tahliye sebeplerinden biridir. <\/strong>Kiralanan\u0131n yeniden in\u015fa edilmesi, imar\u0131 veya esasl\u0131 onar\u0131m\u0131 ve de\u011fi\u015ftirilmesi i\u00e7in yap\u0131lacak i\u015flemler neticesinde yap\u0131lacak i\u015flemler s\u0131ras\u0131nda kiralanan\u0131 kullanmak imkans\u0131z hale gelecek ise kiraya verenin s\u00f6zle\u015fmeyi fesih hakk\u0131 vard\u0131r. Yap\u0131lacak olan onar\u0131m\u0131n yukar\u0131da de\u011findi\u011fimiz gibi esasl\u0131 ve \u00f6nemli olmas\u0131 gerekmektedir. Bu derece \u00f6nemli olmayan ufak tefek yap\u0131m ve onar\u0131m i\u015fleri i\u00e7in kirac\u0131n\u0131n evden \u00e7\u0131kar\u0131lmas\u0131 kanunen m\u00fcmk\u00fcn de\u011fildir. Bu nedene dayal\u0131 olarak a\u00e7\u0131lacak tahliye davas\u0131n\u0131n kira s\u00f6zle\u015fmesinin bitiminden itibaren 1 ay i\u00e7inde a\u00e7\u0131lm\u0131\u015f olmas\u0131 gerekmektedir.<\/p>\n\n\n\n Kirac\u0131n\u0131n Yaz\u0131l\u0131 Tahliye Taahh\u00fctnamesine Ra\u011fmen Evden \u00c7\u0131kmamas\u0131 Halinde Tahliye<\/u><\/strong><\/p>\n\n\n\n Kirac\u0131, kiralanan\u0131, belirli bir tarihte ayr\u0131ca da kiraya verenin ihtar\u0131na gerek kalmadan bo\u015faltaca\u011f\u0131n\u0131 \u00f6nceden usule ve yasaya uygun olarak ge\u00e7erli ve yaz\u0131l\u0131 olacak \u015fekilde bildirmi\u015fse ve buna kar\u015f\u0131n ta\u015f\u0131nmazdan \u00e7\u0131kmazsa, kiraya veren bu nedene dayanarak kirac\u0131y\u0131 ta\u015f\u0131nmazdan \u00e7\u0131karabilir. Bu taahh\u00fcde ra\u011fmen ta\u015f\u0131nmaz bo\u015falt\u0131lmazsa, kirac\u0131y\u0131 ancak icraya ba\u015fvurmak veya dava a\u00e7mak suretiyle \u00e7\u0131karmak m\u00fcmk\u00fcnd\u00fcr. Tahliyeye y\u00f6nelik icra takibinin veya tahliye davas\u0131n\u0131n, taahh\u00fctte belirtilen tarihi izleyen 1 ay i\u00e7inde a\u00e7\u0131lm\u0131\u015f olmas\u0131 zorunludur.<\/strong> Bo\u015faltma taahh\u00fcd\u00fcn\u00fcn bizzat kirac\u0131 taraf\u0131ndan verilmi\u015f olmas\u0131 gerekmektedir. Yaz\u0131l\u0131 tahliye taahh\u00fcd\u00fcne dayanarak a\u00e7\u0131lacak olan tahliye davas\u0131n\u0131 bizzat kiraya veren a\u00e7abilir. \u00d6te yandan tahliye taahh\u00fcd\u00fcn\u00fcn kiralanan\u0131n tesliminden sonraki uygun bir tarihte verilmi\u015f olmas\u0131 gerekir. Yarg\u0131tay Kararlar\u0131na g\u00f6re, kira s\u00f6zle\u015fmesinin ba\u015flang\u0131c\u0131nda verilmi\u015f tahliye taahh\u00fctnamesi \u201ctazyik ve ikrah alt\u0131nda\u201d verilmi\u015f olmas\u0131 ihtimali bulundu\u011fu i\u00e7in ge\u00e7ersiz say\u0131lmaktad\u0131r.<\/p>\n\n\n\n Kirac\u0131n\u0131n ta\u015f\u0131nmaz\u0131 teslim tarihinde taahh\u00fct vermesine ra\u011fmen taahh\u00fcde teslimden sonraki bir tarihin at\u0131lmas\u0131, kanuna kar\u015f\u0131 hile te\u015fkil etti\u011finden taahh\u00fct ge\u00e7ersizdir. Ancak bu durumun ispat k\u00fclfeti kirac\u0131 \u00fczerindedir.<\/p>\n\n\n\n Kirac\u0131n\u0131n Kiray\u0131 \u00d6dememesi Nedeniyle \u0130ki Hakl\u0131 \u0130htarla Tahliye<\/u><\/strong><\/p>\n\n\n\n Kanun, kiralayana kira paras\u0131n\u0131 s\u00fcrekli olarak ge\u00e7 \u00f6demeyi veya \u00f6dememeyi al\u0131\u015fkanl\u0131k haline getiren k\u00f6t\u00fc niyetli kirac\u0131lara kar\u015f\u0131 tahliye davas\u0131 a\u00e7abilme hakk\u0131 tan\u0131nm\u0131\u015ft\u0131r. Kirac\u0131n\u0131n kira bedelini \u00f6deme noktas\u0131nda temerr\u00fcde d\u00fc\u015fmesi belli \u015fartlarda tahliye sebebi olarak kabul edilmi\u015ftir. Kirac\u0131 kira s\u00f6zle\u015fmelerindeki kira s\u00fcresi i\u00e7erisinde, kira bedelini \u00f6demedi\u011fi i\u00e7in kendisine iki hakl\u0131 ihtarda bulunulmas\u0131na sebep olmu\u015fsa, kiraya veren kira s\u00f6zle\u015fmesini feshedebilir<\/u>. <\/strong>Kirac\u0131ya g\u00f6nderilen ihtar yaz\u0131l\u0131 olarak yap\u0131lmal\u0131 ve hangi ay\u0131n kiras\u0131n\u0131n \u00f6denmedi\u011finin a\u00e7\u0131k\u00e7a belirtilmi\u015f olmal\u0131d\u0131r. \u0130htar, 1 kira y\u0131l\u0131 i\u00e7inde farkl\u0131 aylara ait olmal\u0131d\u0131r. E\u011fer ki taraflar kira bedelinin y\u0131ll\u0131k \u00f6denmesini kararla\u015ft\u0131rm\u0131\u015flarsa, bu sebebe dayal\u0131 olarak tahliye davas\u0131 a\u00e7\u0131lamaz. G\u00f6nderilen ihtardan sonra \u00f6deme yap\u0131lm\u0131\u015f olmas\u0131 ihtar\u0131n hakl\u0131l\u0131\u011f\u0131n\u0131 ortadan kald\u0131rmaz. Bu nedene dayal\u0131 olarak a\u00e7\u0131lacak olan tahliye davas\u0131n\u0131n kira s\u00fcresinin bitiminden ba\u015flayarak 1 ay i\u00e7inde a\u00e7\u0131lm\u0131\u015f olmas\u0131 gerekmektedir. <\/u><\/strong>Bir ay i\u00e7inde tahliye davas\u0131 a\u00e7\u0131lmaz ve kira s\u00f6zle\u015fmesi de sona erdirilmezse, art\u0131k bu nedene dayan\u0131larak kirac\u0131 ta\u015f\u0131nmazdan \u00e7\u0131kar\u0131lamaz. <\/p>\n\n\n\n Ayn\u0131 \u0130l\u00e7e veya Beldede Kendisinin ya da Birlikte Ya\u015fad\u0131\u011f\u0131 E\u015finin Ad\u0131na Kay\u0131tl\u0131 Oturulabilecek Konutunun Olmas\u0131 Nedeniyle Tahliye<\/u><\/strong><\/p>\n\n\n\n Bu durumun varl\u0131\u011f\u0131 halinde kiraya veren e\u011fer ki, kira s\u00f6zle\u015fmesinin kurulmas\u0131 s\u0131ras\u0131nda kirac\u0131n\u0131n veya birlikte ya\u015fad\u0131\u011f\u0131 e\u015finin konutu oldu\u011funu bilmiyorsa, s\u00f6zle\u015fmenin bitiminden ba\u015flayarak 1 ay i\u00e7inde s\u00f6zle\u015fmeyi tahliye davas\u0131 yoluyla sona erdirebilir. Bu h\u00fckm\u00fcn uygulanabilmesi i\u00e7in, konutun ayn\u0131 il\u00e7e veya belde s\u0131n\u0131rlar\u0131 i\u00e7inde olmas\u0131 ve bu konutun kirac\u0131n\u0131n kullanmas\u0131na elveri\u015fli bulunmas\u0131 gerekir.<\/p>\n\n\n\n Yine kiraya verenin s\u00f6zle\u015fmesinin bitiminden ba\u015flayarak bu nedene dayal\u0131 olarak 1 ay i\u00e7erisinde tahliye davas\u0131 a\u00e7mas\u0131 gerekir.<\/p>\n\n\n\n 10 Y\u0131ll\u0131k Kira S\u00fcresinin Dolmas\u0131 Nedeniyle Tahliye Hakk\u0131<\/u><\/strong><\/p>\n\n\n\n Kiraya verenin herhangi bir sebep g\u00f6stermeden, kirac\u0131n\u0131n kira s\u00f6zle\u015fmesinden do\u011fan bor\u00e7lar\u0131n\u0131 yerine getiriyor olmas\u0131na ra\u011fmen, on y\u0131ll\u0131k uzama s\u00fcresini takip eden uzama y\u0131l\u0131n\u0131n dolmas\u0131 sebebiyle bu s\u00fcrenin sonunda s\u00f6zle\u015fmeyi sona erdirebilir. TBK m. 347 h\u00fckm\u00fc uyar\u0131nca kira s\u00f6zle\u015fmesi 10 defa uzad\u0131ktan sonra kiraya verene s\u00f6zle\u015fmeyi sona erdirme hakk\u0131 tan\u0131nmaktad\u0131r.<\/p>\n\n\n\n Kira s\u00f6zle\u015fmesinin 10. uzama y\u0131l\u0131n\u0131 takip eden her yeni kira y\u0131l\u0131ndan en az 3 ay \u00f6ncesine kadar kirac\u0131ya yaz\u0131l\u0131 bir ihtarname g\u00f6ndererek bildirimde bulunmak ko\u015fuluyla tahliye talep etme hakk\u0131na sahip olunur.<\/strong><\/p>\n\n\n\n Kirac\u0131n\u0131n Kiralanan\u0131 Ba\u015fkas\u0131na Kiralamas\u0131 veya Yararlanma Hakk\u0131n\u0131 Devretmesi Nedeniyle Kiraya Verenin Tahliye Hakk\u0131<\/u><\/strong><\/p>\n\n\n\n Kirac\u0131, konut olarak kiralad\u0131\u011f\u0131 ta\u015f\u0131nmaz\u0131n tamam\u0131n\u0131 veya bir b\u00f6l\u00fcm\u00fcn\u00fc ba\u015fka birisine kiralayamaz veya yararlanma hakk\u0131n\u0131 devredemez. Kiraya verenin r\u0131zas\u0131 olmadan, kirac\u0131 evi ba\u015fkas\u0131na kiralarsa bu durum kiraya verene kira s\u00f6zle\u015fmesini feshetme hakk\u0131 verir. <\/p>\n\n\n\n Kirac\u0131n\u0131n \u0130flas\u0131 Nedeniyle Fesih<\/u><\/strong><\/p>\n\n\n\n Kira s\u00f6zle\u015fmesi s\u00fcresince kirac\u0131n\u0131n iflas etmesi durumunda, kiraya veren, muaccel olmam\u0131\u015f kira bedelleri i\u00e7in g\u00fcvence verilmesini isteme hakk\u0131na sahiptir. Ancak kirac\u0131 taraf\u0131ndan g\u00fcvence verilmez ise, kiraya veren s\u00f6zle\u015fmeyi derhal feshetme hakk\u0131na sahip olur.<\/p>\n\n\n\n \u00d6nemli Nedenlerle Fesih ve Kirac\u0131n\u0131n Tahliyesi<\/u><\/strong><\/p>\n\n\n\n Kira s\u00f6zle\u015fmesinin devam etmesinin her iki taraf i\u00e7in de \u00e7ekilmez hale gelmesi durumunda bu \u00f6nemli sebeplerin bulunmas\u0131, hem kiraya verene hem de kiralayana fesih bildirim s\u00fcrelerine uyarak kira s\u00f6zle\u015fmesini sona erdirme hakk\u0131 verir. Yani kira ili\u015fkisinin devam\u0131n\u0131n \u00e7ekilmez hale gelmesi, taraflar\u0131n s\u00f6zle\u015fmeyi feshedebilmeleri i\u00e7in yeterlidir.<\/p>\n\n\n\n Kirac\u0131n\u0131n S\u00f6zle\u015fmeye Uymamas\u0131 Nedeniyle Fesih<\/u><\/strong><\/p>\n\n\n\n Kirac\u0131n\u0131n, taraflar aras\u0131nda akdedilen kira s\u00f6zle\u015fmesinden kaynaklanan baz\u0131 y\u00fck\u00fcml\u00fcl\u00fckleri ve bor\u00e7lar\u0131 vard\u0131r. Kirac\u0131n\u0131n bu bor\u00e7lar\u0131n\u0131 herhangi bir hakl\u0131 neden olmaks\u0131z\u0131n yerine getirmemesi halinde, kiralayan \u00f6ncelikle kirac\u0131ya ihtarname g\u00f6nderir. Kirac\u0131 buna ra\u011fmen s\u00f6zle\u015fmeye uymamaya devam ederse kiraya veren s\u00f6zle\u015fmeyi feshedebilir. <\/p>\n\n\n\n Anla\u015f\u0131laca\u011f\u0131 \u00fczere kirac\u0131n\u0131n tahliye edilmesi bak\u0131m\u0131ndan bir\u00e7ok hukuki y\u00f6ntem bulunmaktad\u0131r. Ancak her somut olay i\u00e7in bahsi ge\u00e7en yollardan herhangi biri denenemez. Dolay\u0131s\u0131 ile hangi hukuki y\u00f6ntemin hangi somut olaya uydu\u011fu \u00f6zenle belirlendikten sonra s\u00fcrecin ilerlemesi hak kayb\u0131na u\u011framamak bak\u0131m\u0131ndan olduk\u00e7a \u00f6nemlidir.
